n\u00e3o autorizam a sua deflagra\u00e7\u00e3o. Por\u00e9m, quando o ordenamento jur\u00eddico n\u00e3o trata adequadamente essa mat\u00e9ria, a bagun\u00e7a se instaura no campo trabalhista. \u00c9 esse o caso de muitas greves no setor p\u00fablico.<\/p>\n<p>Cumpre lembrar que a Constitui\u00e7\u00e3o de 1988, no artigo 37, inciso VII, definiu que o direito de greve dos servidores p\u00fablicos ser\u00e1 exercido nos termos e limites estabelecidos em lei complementar. Dez anos depois, a Emenda Constitucional n.\u00b0 19, de 1998, determinou que a regulamenta\u00e7\u00e3o do direito de greve no setor p\u00fablico deve ser feita por interm\u00e9dio de lei espec\u00edfica.<\/p>\n<p>Desde aquela \u00e9poca at\u00e9 hoje, em meio a v\u00e1rios projetos de lei sobre a mat\u00e9ria em quest\u00e3o, nenhum foi aprovado pelo Legislativo. Diante dessa aus\u00eancia de regulamenta\u00e7\u00e3o, n\u00e3o raro, o que tem sido aplicado na esfera do setor p\u00fablico para dirimir movimentos paredistas \u00e9, com algumas adapta\u00e7\u00f5es, a Lei n.\u00b0 7.783 de 1989, que disciplina a greve no setor privado.<\/p>\n<p>A ocorr\u00eancia de greves na \u00e1rea p\u00fablica n\u00e3o \u00e9 um acontecimento espor\u00e1dico, para ser assim tratado com tanta neglig\u00eancia. Pelo contr\u00e1rio, elas se tornaram uma constante no Pa\u00eds e seu n\u00famero cresce a cada ano. Basta ver o per\u00edodo recente, nos registros do Departamento Intersindical de Estat\u00edstica e Estudos Socioecon\u00f4micos (Dieese): em 2009 ocorreram 251 greves na \u00e1rea p\u00fablica; em 2010, 269; em 2011, 325; e em 2012,409.<\/p>\n<p>Vale destacar tamb\u00e9m que a quantidade de greves de servidores tem superado a de empregados do setor privado, como ocorreu em 2011 e em 2012. E em todos os anos os n\u00fameros de horas paradas no trabalho, em raz\u00e3o das greves, \u00e9 muito superior ao registrado nas paredes do setor privado. Quanto ao prolongamento do n\u00famero de horas, isso se deve tamb\u00e9m \u00e0 falta de regulamenta\u00e7\u00e3o da lei de greve e \u00e0s negocia\u00e7\u00f5es serem muito complexas, envolvendo v\u00e1rias inst\u00e2ncias de poder.<\/p>\n<p>Ofato de essas paredes na \u00e1rea p\u00fablica estarem sendo dirimidas tendo como refer\u00eancia alei do setor privado faz com que se tratem de forma igual situa\u00e7\u00f5es bem distintas. A greve na \u00e1rea privada atinge quest\u00f5es que n\u00e3o envolvem a sociedade como um todo. J\u00e1 no caso das paralisa\u00e7\u00f5es no setor p\u00fablico, a popula\u00e7\u00e3o \u00e9 sempre prejudicada. N\u00e3o se pode esquecer de que \u00e9 a pr\u00f3pria popula\u00e7\u00e3o que paga os impostos para sustentar a presta\u00e7\u00e3o dos servi\u00e7os que deixa de receber quando ocorre aparede. Al\u00e9m do mais, as caracter\u00edsticas dos que trabalham no setor p\u00fablico s\u00e3o bem diferentes das dos que s\u00e3o empregados no setor privado. Os contratos de trabalho, os direitos e deveres, em termos trabalhistas, n\u00e3o s\u00e3o os mesmos.<\/p>\n<p>Embora o Brasil, em 2010, tenha ratificado a Conven\u00e7\u00e3o 151 da Organiza\u00e7\u00e3o Internacional do Trabalho (OIT), que garante a livre negocia\u00e7\u00e3o para os servidores p\u00fablicos, ela, por si s\u00f3, n\u00e3o resolve o problema. A pr\u00f3pria conven\u00e7\u00e3o determina que as na\u00e7\u00f5es \u00e9 que devem regular as negocia\u00e7\u00f5es na \u00e1rea p\u00fablica, inclusive salientando as atividades essenciais que p\u00f5em em risco a popula\u00e7\u00e3o.<\/p>\n<p>Assim, urge a promulga\u00e7\u00e3o de uma lei que estabele\u00e7a claramente os limites das greves no setor p\u00fablico. Entre outras defini\u00e7\u00f5es, que ela determine o quantitativo m\u00ednimo de servidores que dever\u00e3o trabalhar durante a paralisa\u00e7\u00e3o e quais s\u00e3o os servi\u00e7os essenciais. A meu ver, alguns servi\u00e7os p\u00fablicos n\u00e3o deveriam parar em hip\u00f3tese alguma, como, por exemplo, transporte coletivo, fornecimento de energia, seguran\u00e7a, abastecimento de \u00e1gua, assist\u00eancia m\u00e9dico-hospitalar, defesa civil, telecomunica\u00e7\u00f5es e servi\u00e7os judici\u00e1rios.<\/p>\n<p>As aspira\u00e7\u00f5es de servidores do governo n\u00e3o podem sobrepor o bem comum, ou seja, o interesse p\u00fablico. Mas a aus\u00eancia de regras claras sobre as paredes no aparelho estatal faz com que os direitos dos usu\u00e1rios dos servi\u00e7os p\u00fablicos, a sociedade, sejam relegados pelos paredistas. E as paralisa\u00e7\u00f5es, nesse setor, s\u00e3o estimuladas, ao contr\u00e1rio do que ocorre na \u00e1rea privada, porque os riscos s\u00e3o quase inexistentes para os grevistas.
